Pursuant to Rule 4(e)(1)(E) of the West Virginia Rules of Civil Procedure, this
ORDER OF PUBLICATION is hereby fi led to notify any and all interested parties of
their right to be present and present any and all claims:
The Estate of Catherine Michelle Fought has brought forth a claim of negligence
arising out of a motor vehicle crash that occurred on June 3, 2020, on West Virginia
Route 14 near Mineral Wells, Wood County, West Virginia, involving Robert Carter. This
crash took Ms. Fought’s Life. The Estate has filed a petition seeking the Wirt County
Circuit Court’s permission to settle all claims at issue in this matter and to distribute
funds. The Honorable Robert Waters will take evidence on August 13, 2021 at 2:00
p.m. at the courtroom on the 2nd floor of the Wirt County Courthouse, #19 Washington
Street, Elizabeth, West Virginia 26143. If you believe you are entitled to damages as a
result of Ms. Fought’s death, you must appear and state all claims before the Court or
forever lose your right to do so.
Petitioner Shasta Bennett and the Estate of Catherine Michelle Fought is represented
by Bruce M. White of 720 Juliana Street, Parkersburg, WV.
